This Dispute Resolution Policy sets out the procedures that will be followed in the event of any disputes or disagreements arising between Humbingo Consultancy Services LLP and its clients in connection with the services provided. By engaging with our services, you agree to the terms and procedures outlined in this policy.

1. Purpose

The purpose of this Dispute Resolution Policy is to ensure that any disputes arising between Humbingo Consultancy Services LLP and its clients are resolved fairly, efficiently, and amicably. We aim to avoid litigation and provide an effective, non-confrontational method for resolving any issues.

2. Dispute Resolution Process

2.1. Informal Resolution

In the event of a dispute, Humbingo Consultancy Services LLP encourages the client to first attempt to resolve the issue informally. This may involve direct communication between the client and the designated representative of Humbingo Consultancy Services LLP. We suggest discussing the matter via email or phone to try to reach a mutual understanding.

2.2. Mediation

If the dispute is not resolved through informal communication, the parties agree to engage in mediation. A neutral third-party mediator will be selected by mutual agreement between Humbingo Consultancy Services LLP and the client. The mediator will work to facilitate a resolution, but the mediation process will not be legally binding.

2.3. Arbitration

If the dispute remains unresolved after mediation, the matter will proceed to arbitration. The arbitration process will be legally binding, and the decision made by the arbitrator will be final and enforceable.

• Arbitration Venue: Arbitration will take place in Anand,Gujarat.
• Arbitrator Selection: The arbitrator will be selected from a panel of qualified individuals agreed upon by both parties. If the parties cannot agree on an arbitrator, one will be appointed by the relevant legal body.
• Arbitration Fees: The parties will equally share the costs of arbitration, unless otherwise decided by the arbitrator.

2.4. Timeframe for Dispute Resolution

Both parties agree to work towards resolving the dispute promptly. A period of 10 days will be provided for informal resolution, and a further period of 7 days for mediation. If necessary, arbitration should be initiated within 7 days following the conclusion of mediation.

3. Governing Law and Jurisdiction

This Dispute Resolution Policy shall be governed by and construed in accordance with the laws of India. In the event that arbitration is required, the laws of India will apply.

Jurisdiction: Any legal actions or proceedings related to disputes arising from this policy will be subject to the exclusive jurisdiction of the courts located in Anand,Gujarat.

4. Confidentiality

The dispute resolution process, including mediation and arbitration, will be confidential. Both parties agree not to disclose any details of the dispute or the process to any third party unless required by law or agreed upon in writing.

5. Exceptions

The procedures outlined in this Dispute Resolution Policy do not apply to actions for emergency relief or any other matter that requires urgent attention. If either party seeks injunctive or other equitable relief, they may seek such relief from a court of competent jurisdiction.

6. Compliance with Dispute Resolution Process

Both Humbingo Consultancy Services LLP and the client are required to make reasonable efforts to participate in the dispute resolution process in good faith. Failure to comply with this policy may result in the forfeiture of any claims or defenses that could have been raised in the dispute resolution process.

7. Amendments to this Policy

Humbingo Consultancy Services LLP reserves the right to amend this Dispute Resolution Policy at any time. Any changes will be communicated to clients via email or updated on the company’s website.
